1. Acceptance of Terms
By accessing or using the Set2Build platform ("Service"), operated by Rosenzweig Emanuel Frantz ("we", "us", or "Company"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Set2Build is a construction site safety reporting and management platform. The Service enables construction companies and their personnel to document, report, and manage safety-related activities on construction sites, including safety inspections, incident reporting, and compliance documentation.
3. User Accounts and Authentication
To use the Service, you must create an account or authenticate through one of the supported methods, which may include organizational single sign-on (SSO), one-time password (OTP), or other authentication mechanisms offered by the Service. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Permitted Use
You agree to use the Service only for its intended purpose of construction safety management. You shall not:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Reverse engineer, decompile, or disassemble the Service.
- Transmit any malicious code, viruses, or harmful content through the Service.
- Share your account credentials with unauthorized parties.
- Upload content that infringes on intellectual property rights of third parties.
5. Data and Content
You retain ownership of all data and content you submit through the Service, including safety reports, photos, documents, and other materials. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you and your organization. We will not sell or share your data with third parties except as required to operate the Service or as required by law.
6. Report Distribution
Safety reports and related documents generated through the Service are distributed exclusively within your organization, to authorized users as defined by your organization's administrators. We do not share reports with external parties unless explicitly instructed by your organization.
7. Third-Party Integrations
The Service may integrate with third-party platforms and services for authentication, document management, communication, or other purposes. Your use of these integrated services is subject to the respective terms of service and privacy policies of those third-party providers. We access only the data and permissions necessary to provide the Service functionality.
8. Availability and Support
We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.
9. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. The Service is a tool for safety management and documentation; it does not replace professional safety assessments, regulatory compliance obligations, or professional judgment. Our total liability shall not exceed the fees paid by you for the Service during the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export your data prior to termination.
12. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated through the Service or via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
13. Governing Law
These terms are governed by the laws of the State of Israel. Any disputes shall be resolved in the competent courts of the Central District of Israel.
